Australian Report reveals link between child protection and youth justice supervision

The Australian Institute of Health and Welfare (AIHW) has recently released a report exploring the link between child protection and youth justice contact. The report Young People in Child Protection and Under Youth Justice Supervision 2013 – 14 found that 24% of young people in youth justice detention were also in the child protection system in the same year. The report also found that those who were younger at first contact with the youth justice system were more likely to also be in child protection.

The report reflects outcomes from other studies looking at links between victimisation, maltreatment, child protection and juvenile justice: The 2008 Report of the Special Commission of Inquiry into Child Protection Services in NSW found that 28% males and 39% females under youth justice supervision had a history of child protection and placements in out-of-home-care (OOHC). A 2010 study by McFarlane found that over a third (34%) of young people appearing in the Children’s Court had placements in OOHC. In 2011, Cashmore explored the nexus between abuse, neglect and offending which is available to read here. More recently, a study by Fernandez and colleagues found that many of the young people in the juvenile justice system have a history of contact with child protection departments and many have had multiple OOHC placements.

While there is clearly a growing body of research demonstrating the relationship between welfare and justice systems, the AIHW publication is the first of its kind using a new national linked database. Such a positive step in data linkage allows for exploration of the pathways through these systems, and can assist case workers, researchers and policy makers to work towards optimal outcomes for children and their families.

Correctional Populations in the United States, 2014

This report presents statistics on persons supervised by adult correctional systems in the United States at yearend 2014, including offenders supervised in the community on probation or parole and those incarcerated in state or federal prison or local jail.

It describes:

  • the size and change in the total correctional population during 2014
  • the downward trend in the correctional population and correctional supervision rate since 2007
  • the impact of changes in the community supervision and incarcerated populations on the total correctional population in recent years.

Appendix tables provide statistics on other correctional populations and jurisdiction-level estimates of the total correctional population by correctional status and sex for select years.

Aktuelle Entscheidung des BVerfG: Ordnungswidrigkeitentatbestand der sexuellen Handlung mit Tieren ist verfassungsgemäß

Kurztext der Entscheidung vom 18.2.2016:

Mit heute veröffentlichtem Beschluss hat die 3. Kammer des Ersten Senats des Bundesverfassungsgerichts eine Verfassungsbeschwerde gegen einen Ordnungswidrigkeitentatbestand im Tierschutzgesetz nicht zur Entscheidung angenommen.

Danach können sexuelle Handlungen mit Tieren, durch die sie zu einem artwidrigen Verhalten gezwungen werden, mit einer Geldbuße bis zu 25.000 Euro geahndet werden.

Die zwei Beschwerdeführer fühlen sich zu Tieren sexuell hingezogen. In Anbetracht des vom Gesetzgeber verfolgten Schutzzwecks ist der durch das Verbot bewirkte Eingriff in das sexuelle Selbstbestimmungsrecht der Beschwerdeführer verfassungsrechtlich gerechtfertigt.
Der Ordnungswidrigkeitentatbestand genügt darüber hinaus den Anforderungen des Bestimmtheitsgebots.

This includes those aged under 18 and 18-year-olds. Some 18-year-olds remain in the secure estate for children and young people if they only have a short period of their sentence to serve, to avoid disrupting their regimes.

The publication also contains more detailed information on the make-up of the custody population by legal basis for detention, accommodation type, age group, gender, ethnicity and region of origin. Data are also provided on a trend basis dating back to 2000 to 2001 and 2005 to 2006 onwards for more detailed data.

Migrationsbericht 2014

EU-Binnenmigration und Asylanträge nehmen zu

Bundesinnenminister Dr. Thomas de Maizière hat am 5. Februar den vom Bundesamt für Migration und Flüchtlinge (BAMF) erstellten Migrationsbericht 2014 vorgestellt. Dieser informiert über die verschiedenen Arten von Migration, gibt einen umfassenden Überblick über das Migrationsgeschehen 2014 und vergleicht die Ergebnisse mit weiteren EU-Mitgliedsstaaten. Er zeigt unter anderem auch, dass die Bedeutung der Zuwanderung für Deutschland weiter wächst, insbesondere im Blick auf den demographischen Wandel und die Gewinnung von Fachkräften. Im Vergleich zu den Vorjahren stieg 2014 weiterhin die Anzahl der Zuzüge. Etwas geringer war der Anstieg der Fortzüge. Insgesamt ergab sich ein Wanderungsgewinn von 550.000 Menschen, der höchste seit dem Jahr 1992. Im Jahr 2015, insbesondere seit Jahresmitte, hat die Zuwanderung nach Deutschland weiter erheblich an Dynamik gewonnen. Dies ist vor allem auf die stark gestiegene Asylzuwanderung zurückzuführen.

EU-Binnenmigration: Polen ist seit 1996 das Hauptherkunftsland von Zugewanderten, dies zeigte sich auch 2014 wieder. Weiter angestiegen ist die Zuwanderung aus den zum 1. Januar 2007 zur EU beigetretenen Staaten Rumänien und Bulgarien sowie aus dem zuletzt beigetretenen Mitgliedstaat Kroatien. Der Anteil der EU-Binnenmigration am gesamten Zuwanderungsgeschehen nach Deutschland ist, trotz steigender absoluter Zahlen, leicht rückläufig (55 %). Grund dafür ist die überproportionale Zunahme des Zugangs von Asylsuchenden.

Asylanträge um 60 Prozent gestiegen: Eine deutliche Zunahme war bei der Zahl der Asylanträge festzustellen. 2014 wurden etwa 203.000 Asylanträge (Erst- und Folgeanträge) registriert. Dies entspricht einem Anstieg um 60 Prozent gegenüber 2013. Deutschland ist damit in der EU der Mitgliedstaat, in dem die meisten Anträge gestellt wurden. Diese Entwicklung setzte sich verstärkt im Jahr 2015 fort. So wurden bereits Ende Juli 2015 mehr Asylanträge als im gesamten Vorjahr gezählt.

Zuwanderung von Fachkräften: Die Zuwanderung von Fachkräften aus Drittstaaten stieg im Vergleich zum Vorjahr um 13 Prozent an. Hauptherkunftsländer waren Indien, die Vereinigten Staaten, Bosnien-Herzegowina und China. Zudem sind 2014 mehr ausländische Staatsangehörige nach Deutschland gekommen, um an einer deutschen Hochschule ein Studium zu beginnen, als jemals zuvor.

Data for these reports are from BJS's Survey of Sexual Violence (SSV), which has been conducted annually since 2004.

Sexual Victimization Reported by Juvenile Correctional Authorities, 2007–12, presents national estimates of nonconsensual sexual acts, abusive sexual contacts, staff sexual misconduct, and staff sexual harassment reported by correctional authorities in state juvenile correctional systems and local and private juvenile correctional facilities from 2007 to 2012.

This report examines substantiated incidents, including characteristics of victims and perpetrators, location, time of day, nature of injuries, impact on the victims, and sanctions imposed on the perpetrators.

Erfolglose Verfassungsbeschwerde gegen die Neuregelung der Gefangenenvergütung in Rheinland-Pfalz

Mit einem am 3. Februar veröffentlichtem Beschluss hat die 2. Kammer des Zweiten Senats des Bundesverfassungsgerichts eine Verfassungsbeschwerde gegen die Neuregelung der Vergütung von freiwillig arbeitenden Strafgefangenen in Rheinland-Pfalz nicht zur Entscheidung angenommen, nach der die nicht monetäre Vergütungskomponente ersatzlos wegfiel. Diese wurde zusätzlich zur monetären Vergütungskomponente unter anderem in Form von Freistellungstagen gewährt, die auch als Urlaub aus der Haft genutzt oder auf den Entlassungszeitpunkt angerechnet werden konnten. Die Kammer hat allerdings hervorgehoben, dass Arbeit im Strafvollzug einen gewichtigen Resozialisierungsfaktor darstelle, dessen Wirksamkeit davon abhänge, dass die geleistete Arbeit eine angemessene Anerkennung findet. Ob der Strafgefangene freiwillig arbeitet oder eine zugewiesene Pflichtarbeit ausübt, spielt dabei keine Rolle. In beiden Fällen muss die Anerkennung geeignet sein, dem Strafgefangenen den Wert regelmäßiger Arbeit vor Augen zu führen.

Nine per cent fewer children entering the youth justice system than a year ago

The number of children entering the youth justice system for the first time has fallen by 9% in 2014/15. This is a reduction from 22,648 in 2013/14 to 20,544 according to the Annual Youth Justice Statistics, published yesterday, 28 January.

The figures also show that there are fewer young people committing offences than ever before, with the number of proven offences falling to 87,160 – down 4% on 2013/14. Similarly, the number of young people in custody has fallen to 1,037 on average in 2014/15 – down 15% on the average for 2013/14.

The number of young people in the reoffending cohort from 2013/14 (the period for which we have the latest data) has also decreased by 20%, and the number of reoffenders and reoffences have fallen by 15% and 12% respectively. However, as the size of the total offender cohort has fallen by a greater proportion than the number of reoffenders, the reoffending rate has increased. The reoffending rate rose by 1.9 percentage points compared with 2012/13, to 38%. Historically the reoffending rate for 10 to 14 year olds has been lower than that for 15 to 17 year olds, but now the reoffending rate for 10 to 14 year olds is higher than that for 15 to 17 year olds (38.9% and 37.8% respectively).

Lin Hinnigan, the YJB’s Chief Executive said: “It is very encouraging to see 2,100 fewer young people entered the youth justice system, that there are even fewer in custody and the number of proven offences is falling. “Reducing reoffending remains a priority for us. We are drilling down into the data to examine how the frequency and seriousness of offending has changed and we continue to develop and share effective practice in addressing reoffending behaviour with others in the sector.”

Lin Hinnigan added: “The high proportion of young people in the youth justice system from Black and Minority Ethnic (BAME) backgrounds (20%), remains very disappointing. We are working directly with youth offending teams where we see the highest levels of BAME children in the system. But it remains a priority for us all to drive change which can impact this disproportionality.”

President Obama Bans Solitary Confinement for Juveniles in Federal Prisons

 

On January 25, 2016, President Obama announced a ban on the use of solitary confinement for juveniles in federal prisons. The President outlined his executive actions in an opinion piece in The Washington Post, in which he wrote that solitary confinement—especially for juveniles and people with mental illness—has the “potential to lead to devastating, lasting psychological consequences.” The President said he plans to adopt the policy recommendations outlined in a Justice Department report on the use of solitary confinement in federal prisons, including banning solitary confinement for juveniles. Further, the President encouraged state and local corrections systems to examine their practices and noted “These steps will affect some 10,000 federal prisoners held in solitary confinement — and hopefully serve as a model for state and local corrections systems.”
